Commercial Equine Liability: This type of coverage is essential if you perform any commercial equestrian activities such as boarding horses, riding instruction, horse training, breeding, horse sales, etc. Liability coverage is provided if you are sued by a third party who is injured or whose property is damaged (excluding horses: see Care, Custody, & Control). The commercial equine liability policy covers defense fees and pays claims for which you are legally liable up to the policy limits.
Care, Custody & Control: This coverage is essential for anyone who boards, trains, or breeds horses they do not own. Standard general liability insurance excludes coverage for personal property (in this case non-owned horses) in your care, custody, or control. This gap in your equine liability coverage can be filled in the event one of those horses is injured or dies while in your care and you are found legally liable. This policy will provide for the medical care or replacement cost of the horse up to the policy limits.
You cannot purchase Care, Custody & Control coverage alone – it must be added to your Commercial General Equine Liability policy. This insurance may also provide coverage for incidental trailering of clients’ horses but is NOT intended to cover for commercial hauling operations. Personal/individual’s horse owner’s liability insurance
Horse owners face unique liability exposures that may not be adequately covered under normal personal liability policies. Private Horse Owner’s liability coverage is designed to respond in the event legal action is taken against you by a third party for bodily injury or property damage caused by a personal pleasure or show horse that you own or lease, and you are found legally negligent and liable for such damages.
Individual owners of personal horses or show horses who do not derive income nor are involved commercially are eligible. You would not expect this type of policy to respond if you were pursued for damages by individuals who handle your horse as part of their business or employment, such as your trainer, farrier, veterinarian, boarding facility or their employees. Also, if you are leasing the horse, or if you own the horse and are leasing it to another party, special provisions apply.
Riding or hunt club
This type of policy is designed to provide liability coverage for equine member organizations like hunt clubs and riding clubs, in the event that a third party is hurt or their property is damaged at a club function or event. This type of coverage can include public event days where non-members participate, or to which the general public is invited.
Horse shows or events
If you organize horse shows, equestrian events, or clinics, you should consider a commercial general liability policy to protect yourself and/or your organization in the event you are pursued legally by a third party for bodily injury or property damage they feel was caused by your negligence. Coverage is provided for the days the activity takes place and can also include coverage for a certain number of days for set-up and take-down.
Racehorse owners’ insurance
Our carriers provide a Racehorse Owner’s Liability Insurance Policy (RHOL) for racing stock owners that are not directly involved in breeding horses, training horses, or racing horses, but contract with independent contractors. Certificates of insurance should always be obtained from these independent contractors. Should a third party be injured or property damaged as a result of your horse’s racing activities, our carriers will, subject to policy exclusions, defend you in court and pay claims for which you are legally liable. Policy limits are available up to $5,000,000.
